Subject: Upholding the Canadian Bill of Rights – Request for Support in the CFIA Appeal

I am writing to you as a concerned citizen regarding a case currently before the Federal Court of Appeal: Universal Ostrich Farms Inc. v. Canadian Food Inspection Agency. This appeal raises fundamental legal issues that directly affect the rights of all Canadians—namely, due process, property protection, and fair hearing guarantees under the Canadian Bill of Rights.
As you are aware, Section 1(a) of the Canadian Bill of Rights affirms:
“the right of the individual to life, liberty, security of the person and enjoyment of property, and the right not to be deprived thereof except by due process of law.”
And Section 2(e) guarantees:
“the right to a fair hearing in accordance with the principles of fundamental justice.”
These rights are not optional. They are statutory guarantees that remain binding on all federal institutions, including the Canadian Food Inspection Agency (CFIA), and fall squarely under your oversight responsibilities as a federal legislator.
It has come to my attention that in the case at issue, the CFIA exercised regulatory powers that resulted in arbitrary culling, deprivation, or destruction of property without proper notice, hearing, or disclosure of evidence—a pattern that deeply concerns me and many others across the country.
I respectfully request that you:
Publicly support the right of interveners to be heard in this appeal—especially those affected by overreach or lack of procedural fairness.
Call on the Minister of Justice to fulfill their statutory duty to ensure that all federal legislation and enforcement complies with the Canadian Bill of Rights.
Support judicial interpretation of any relevant legislation in a manner consistent with Canadian Bill of Rights Sections 1(a) and 2(e), or if not possible, support striking down any provisions that violate these rights.
Ensure accountability for federal actors who apply or enforce laws in a manner that violates these protected rights.
This case represents more than one farm—it represents the rule of law, the importance of natural justice, and the restraint of arbitrary state power. I urge you to stand with those who are defending our lawful rights and to act as a guardian of the legal protections all Canadians are entitled to.
